Q: On e-commerce platforms, it is common to see imported canned milk powder without Chinese labels. Is it legal to purchase such milk powder? After customs clearance, can the absence of Chinese labels be considered a violation of mandatory regulations for prepackaged foods?
A: In accordance with the provisions of the fourth paragraph of Article 30 of the Measures of the People's Republic of China for the Administration of Import and Export Food Safety (Order No. 249 of the GACC), the label of an imported infant and young children formula milk powder in Chinese must be printed on the smallest sales package. However, if the cross-border e-commerce retail imported infant and young children formula milk powder is purchased from cross-border e-commerce platforms, according to the Notice on Refining Administration on Cross-border E-Commerce Retail Import issued by six ministries including the Ministry of Commerce and the Development and Reform Commission, because the commodity conforms to the quality, safety, health, environmental protection, labeling and other standards or technical specifications of the place of origin, there may be differences with Chinese standards, and may be no Chinese label, consumers can view the Chinese electronic label of the commodity through the website. When purchasing products through the cross-border e-commerce platform, the platform should provide a risk notice to consumers on the product ordering page or other prominent positions, and consumers need to bear the risk by themselves.
