In order to further improve the quality and safety of infant and young children formula milk powder, in accordance with the relevant provisions of the Food Safety Law and the registration and licensing of infant and young children formula milk powder, the State Administration for Market Regulation organized the drafting of the Announcement on Matters Relating to Further Strengthen the Management of Raw and Auxiliary Materials for Infant and Young Children Formula Milk Powder (Draft for Comments), which is now open to the public for comments. The deadline for feedback is November 17, 2024.

I. Infant formula milk powder manufacturers should establish a production quality management system in accordance with laws and regulations, set up quality and safety control requirements for raw and auxiliary materials, and improve the management system of procurement and acceptance of raw and auxiliary materials. Compound ingredients that have already met the nutritional indicator requirements of the national food safety standards for infant and young children formula food should not be used as raw materials to produce infant formula milk powder.

II. Enterprises that adopt dry process to produce infant formula milk powder should take measures to ensure that the raw and auxiliary materials such as whole milk powder, skim milk powder, whey powder, whey protein powder, vegetable oil (fat powder), vitamins and trace elements used not only meet the corresponding food safety standards, but also their microbiological indicators should meet the requirements of product standards for infant formula milk powder.

III. Enterprises that use base powder to produce infant formula milk powder should gradually use base powder produced by enterprises with infant formula milk powder production qualifications within two years from the date of publication of this announcement.

IV. Enterprises that use base powder to produce infant formula milk powder should conduct on-site quality and safety audits on the manufacturers of base powder, to ensure that they implement the hazard analysis and critical control point system in accordance with the requirements of the National Food Safety Standard Good Manufacturing Practice for Dairy Products (GB 12693) and the National Food Safety Standard Good Manufacturing Practice for Infant and Young Children Formula Food (GB 23790), comply with the corresponding content of base powder in the formula registration certificate, and conduct batch-by-batch inspection of base powder before leaving the factory.

V. Enterprises that use base powder to produce infant formula milk powder should formulate base powder quality control documents, and implement full-item inspection on each batch of base powder entering the factory, strictly manage its storage and use, and shorten the service life of base powder.

VI. Encourage the use of cow's milk or goat's milk as raw materials to directly process infant formula milk powder. The words "processed with cow's milk" or "processed with goat's milk" can be marked under the product name on the principal panel of the label of young children formula for those over 1 year old, and the total area of the fonts should not exceed one-half of the total area of the fonts used for the product name. After the label adjustment, the product should be filed with the provincial market supervision department as required before it is put on the market, and there is no need to apply for change registration of product formula. For product formulas of infant formula milk powder that are newly applied for registration to use base powder, the base powder should be directly processed from cow's milk or goat's milk.

VII. Provincial market supervision departments should strictly implement the filing management of production licenses, raw materials, etc. of infant formula milk powder, urge enterprises to fulfill their main responsibilities for food safety, and strictly check the compliance of raw and auxiliary materials, product formulas, production processes, factory inspections, labeling and indication, etc.; For enterprises that use base powder to produce infant formula milk powder, the specifications of base powder and the name of the manufacturer should be indicated in the license details.

If the current requirements for registration and licensing of infant formula milk powder are inconsistent with this announcement, this announcement should prevail.
