Recently, Abbott Trading (Shanghai) Co., Ltd. was fined by China (Shanghai) Pilot Free Trade Zone Market Supervision Department for claiming that non-health food infant and young children formula milk powder have the functions of "improving growth and development" and "laxative" in the live broadcast of the online store, violating the Advertising Law, etc.

In order to increase product sales and enhance product awareness, Abbott launched live broadcast promotion activities for infant and young children formula milk powder. During the live broadcast, it was claimed that the product "can stimulate the potential of height" when introducing and promoting "Abbott Eleva Organic Children's Formula Formulated Milk Powder Stage 4"; when introducing and promoting "Abbott Eleva Pure Young Children Formula Milk Powder Stage 3", it was claimed that the product "can reduce such cases of constipation and reduces diarrhea". The above two products are not health food, but the "improvement of growth and development" and "laxative" claimed in their advertisements belong to the functions of health food.

Abbott's claims for non-health food infant and young children formula milk powder in the live broadcast violated Article 38, paragraph 1 of the Regulations on the Implementation of the Food Safety Law, Foods other than health food shall not claim to have health functions; Article 9, Item 11 of the Advertising Law, advertisements shall not have the following circumstances: (11) Other circumstances prohibited by laws and administrative regulations. It constitutes an illegal act of claiming that foods other than health food have health functions in advertisements. According to Article 57, Item 1 of the Advertising Law, the China (Shanghai) Pilot Free Trade Zone Market Supervision Department ordered Abbott to stop publishing illegal advertisements and fined Abbott 200,000 Yuan.
