In order to support Hainan's comprehensive deepening of reform and opening up and promote the implementation of Hainan's free trade port policy, the Tenth Session of the Standing Committee of the Fourteenth National People's Congress decided: Authorize the State Council to temporarily adjust the application of relevant provisions of the Food Safety Law of the People's Republic of China in Hainan Free Trade Port (catalogue attached), for a period of five years, starting from the date of implementation of this decision.
The People's Government of Hainan Province shall, in accordance with the principle of consistency of power and responsibility, lead, organize and coordinate the supervision and management of the safety of relevant health food and food for special medical purpose, clarify the specific scope, conditions and procedures for approval, improve the supervision and management system and emergency response mechanism during and after the event, assume relevant supervision and management responsibilities, strengthen the construction of supervision and management capabilities, effectively prevent and control risks, ensure food safety, and effectively safeguard the health and life safety of the people. The specific management measures shall be formulated by the People's Government of Hainan Province and implemented after approval by the food safety supervision and administration department of the State Council. The State Council and its relevant departments shall strengthen guidance, coordination and supervision, summarize work experience in a timely manner, and report to the Standing Committee of the National People's Congress on the temporary adjustment of the application of relevant legal provisions.
This decision shall come into force on October 1, 2024.
