Q: Is imported canned milk powder without Chinese label on the e-commerce platform compliant? Is it a violation of the mandatory requirement for prepackaged food without Chinese label after import declaration?
A: In accordance with the provisions of the fourth paragraph of Article 30 of the Measures of the People's Republic of China for the Administration of Import and Export Food Safety (Order No. 249 of the GACC), the label of imported infant and young children formula milk powder in Chinese must be printed on the smallest sales package.
However, if the cross-border e-commerce retail imported infant and young children formula milk powder purchased from cross-border e-commerce platforms, according to Notice on Refining Administration on Cross-border E-Commerce Retail Import by six ministries including the Ministry of Commerce and the Development and Reform Commission, since the commodities meet the requirements for quality, safety, health, environmental protection, labeling and other standards or technical specifications of the place of origin, there may be differences with China's standards, and may be no Chinese label.
In particular, it should be noted that the platform should provide consumers with a risk notice on the product ordering page or other prominent locations.
