The prepackaged food — Matcha Powder sold by a Shanghai Food Co., Ltd. has "produced by EU organic certification standards" and the EU organic certification mark printed on the smallest sales package. The product promotion pages used "the product has passed the EU organic certification" "Hangzhou thousand mu of EU organic certification tea garden" and EU organic certification marks, no pesticides, no chemical fertilizers, no growth regulators, no antibiotics and other text expressions and patterns. There are literal expressions and patterns that may mislead the public thinking that the product is an organic product. The above behavior violates Article 35 (1) of the Measures for the Management of Organic Product Certification: those who have not obtained organic product certification.
According to Article 50 of the Measures for the Management of Organic Product Certification, "for the literal expressions and patterns that contain the words 'organic' and 'ORGANIC' on products or product packages and labels that may mislead the public thinking that the product is an organic product, the local certification supervision department shall order it to make corrections and impose a fine of not more than 30,000 Yuan". Therefore, the Shanghai Xuhui District Market Supervision Department ordered the company to make corrections immediately and imposed a fine of 5,000 Yuan.
